Status: House P&E Committee (Privileges & Elections); [companion Senate bill has not yet been filed].
Justification: Women’s rights are not well protected under the constitution–meaning women can still be discriminated against on the basis of sex.
When the Constitution was written and began with the phrase “We the people of the United States…”, it meant “We the men (white property-holders) of the United States …” and was never intended to grant equal protections under the law to women. This has never changed. The Constitution still does not protect clearly against discrimination based on sex.
The late Supreme Court Justice, Antonin Scalia, said publicly: “Certainly the Constitution does not require discrimination on the basis of sex. The only issue is whether it prohibits it. It doesn’t.”
The Equal Rights Amendment would provide stronger assurance of equal rights for women and men because the courts would use the highest standard to safeguard these rights.
LWVUS Position: The League of Women Voters of the United States supports equal rights for all under state and federal law.
